{"id":2139,"date":"2020-08-19T19:37:00","date_gmt":"2020-08-19T17:37:00","guid":{"rendered":"https:\/\/zellerseyfert.com\/?p=2139"},"modified":"2021-09-20T20:07:10","modified_gmt":"2021-09-20T18:07:10","slug":"termination-of-employment-dispute-interim-injunction-obtained","status":"publish","type":"post","link":"https:\/\/zellerseyfert.com\/en\/termination-of-employment-dispute-interim-injunction-obtained\/","title":{"rendered":"Termination of Employment Dispute: Interim Injunction Obtained"},"content":{"rendered":"\n<h2 class=\"wp-block-heading\">Arbeitsgericht Berlin approves our application for interim injunction<\/h2>\n\n\n\n<p><strong>ZELLER &amp; SEYFERT\u00a0<\/strong>successfully obtained an interim injunction on behalf of our client (Plaintiff) against a large corporation, a worldwide market leader in the pharma industry (Defendant), regarding a disputed\u00a0<a href=\"https:\/\/zellerseyfert.com\/expertise\/german-employment-law\/termination-and-resignation\/\" target=\"_blank\" rel=\"noreferrer noopener\">termination of employment<\/a>. The Defendant has been represented by one of the largest international law firms with US origin.<\/p>\n\n\n\n<p>Our client is a&nbsp;<strong>senior employee<\/strong>&nbsp;of long standing at the said corporation and had been terminated due to a corporate restructuring.<\/p>\n\n\n\n<p>It is our and our client\u2019s position that this termination was not handled in accordance with the provisions of the&nbsp;<em>Kuendigungsschutzgesetz<\/em>&nbsp;and the Betriebsverfassungsgesetz.<\/p>\n\n\n\n<p>Representing our client,&nbsp;<strong>ZELLER &amp; SEYFERT<\/strong>&nbsp;have filed case to challenge this termination and, in the meantime, we have successfully obtained an injunction which ensures that our client, under the provisions of \u00a7102, Subsection 5, Sentence 1 of the Betriebsverfassungsgesetz \/ Works Constitution Act, is entitled to continue to be employed by the defendant.<\/p>\n\n\n\n<p>This employment will continue under unchanged working conditions until the termination dispute is settled.
