This has recently been decided by the Higher Labor Court of Mecklenburg-Vorpommern (decision dated 26.09.2013 \u2013 reference 2 Sa 60\/13).<\/p>\n\n\n\n<p>The court states it is crucial under\u00a0<a href=\"https:\/\/zellerseyfert.com\/expertise\/german-employment-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">German Employment Law<\/a>\u00a0that the following prerequisites are met:<\/p>\n\n\n\n<p><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>the employer has to take the decision to instruct\u00a0<strong>according to his best judgment<\/strong><\/li><li>every instruction has to be seen and\u00a0assessed as a single case<\/li><li>the employer has to carefully weight both, his\u00a0<strong>interest in flexibly using his staff<\/strong>\u00a0and the\u00a0<strong>employee\u2019s interest in being permanently employed on a higher level<\/strong><\/li><li><strong>EU law<\/strong>\u00a0implies to make sure there is\u00a0<strong>no institutional abuse of exceptional measures<\/strong>\u00a0(e.g. when such an instruction has been used for a\u00a0<strong>notably long period<\/strong>\u00a0or with a\u00a0<strong>relative frequency<\/strong>).<\/li><\/ul>\n\n\n\n<p>Where the employer fails to meet these prerequisites the&nbsp;<strong>employee may claim to be permanently employed<\/strong>&nbsp;on a higher level under&nbsp;German law.
